US Customs and Border Protection (CBP) is increasing enforcement of Importer of Record (IOR) information submitted on CBP Form 5106. Enhanced enforcement will begin in 30 days, and inaccurate information may result in the immediate voiding of an IOR number.

The change is part of CBP’s initial implementation of Executive Order 14411, “Strengthening Customs Enforcement.” The agency is enhancing procedures to verify the accuracy of information provided by new and existing Importers of Record.

What Is Changing?

Importers, or customs brokers acting on their behalf, must provide accurate and complete IOR information to CBP.  This notice provides CBP with the authority to void any number CBP finds to be inaccurate.

CBP Form 5106, Create/Update Importer Identity Form, is used to establish and maintain an importer’s identity with CBP. Required mandatory information includes:

  • Importer name
  • EIN, SSN, or CBP-assigned number
  • Mailing address
  • Physical address, if different
  • Phone number
  • Email address

The form also includes information related to business structure, beneficial ownership, and company officers.

CBP warned that inaccurate information may result in immediate voiding of the IOR number and other enforcement actions. A voided number will prevent an importer’s ability to import goods.
