New Round of Product Exclusions Announced for First Three Lists of Section 301 Tariffs

More good news for importers. The office of the U.S. Trade Representative (USTR) announced product exclusions for List 1, List 2 and List 3 of Section 301 tariffs on goods from China. This round represents the seventh set of exclusions for List 1, and the second set of exclusions for Lists 2 and 3 respectively. These exclusions combined amount to 437 specially prepared product descriptions from 1,170 separate exclusion requests.

Effective Date of Exclusions

  • List 1 – Exclusions retroactive to July 6, 2018 and is effective for one year from publication in the Federal Register.
  • List 2 – Exclusions retroactive to August 23, 2018 and is effective for one year from publication in the Federal Register.
  • List 3 – Exclusions retroactive to September 24, 2018 and effective through August 6, 2020

Next Step

Importers who paid tariffs on any of these excluded products dating back to the stated retroactive dates should apply for a refund.
