Following perceived systematic challenges in collecting duties, President Trump has paused the Chinese and Hong Kong exclusions from Section 321 through an amendment to the executive order from February 1, 2025.

The update clarifies that certain goods may still qualify for duty-free de minimis treatment under U.S. law, but this exemption may be discontinued once the Secretary of Commerce confirms that effective systems are in place to process and collect tariffs.
