The International Longshoremen’s Association (ILA) contract is set to expire on September 30, which raises concerns for a potential strike at East Coast and Gulf Coast ports. A strike would not only cause significant disruptions but also a potential for “compensatory” detention and demurrage charges—as the FMC has not clarified that carriers cannot impose charges during a strike.

Proactive Measures to Take

  1. Clear containers early, if possible.
  2. Keep records of all appointment attempts for pickups and returns.
  3. Inform carriers immediately if you can’t retrieve or return containers.
  4. Be prepared to file a complaint and submit any detention and demurrage invoices to the FMC for review.

Mohawk Global will continue to monitor these developments and provide updates as we receive them.
