The Office of the US Trade Representative (USTR) has announced further delays in granting exclusions from Section 301 tariffs on imports from China. The USTR is seeking public input on:

  • Extending temporary exclusions for specific machinery—specifically Chapters 84 and 85.
  • Adding new products to the exclusion list.

Companies seeking tariff exclusions must provide detailed information, including:

  • 10-digit HTSUS numbers
  • Product descriptions
  • Availability in the US and third countries
  • SKU or product number
  • Manufacturer information

The USTR has not indicated plans to retroactively apply granted exclusions for the two-year investigation period. Companies that have paid Section 301 tariffs since March 2022 should submit comments to the USTR and the Office of Management and Budget (OMB) by September 16 to advocate for change. Once approved, the USTR will open a new portal for exclusion requests, allowing objections and rebuttals.
