FMC’s New Rules & Regulations Since OSRA 2022

The FMC has been busy with new regulations since the passing of OSRA on June 16, 2022. The most impactful of these is the final rule on Demurrage & Detention Billing Practices that the industry has been patiently awaiting. This panel will discuss the impact of this and all other rules released by the FMC since OSRA.

Understanding Broker Expectation with Clients and Customs. Who is responsible for knowing what is in the box?

The new broker regulations (19CFR §111) have been in place for over a year. What is the standard that CBP will hold a broker to? How are CBP expectation changing? This panel will address new challenges to the customs broker/importer relationship, from obtaining a power of attorney to termination of a broker/importer relationship, as the new regulations place additional requirements on brokers. The evolution of expectations for brokers such as Reasonable Care versus Responsible Supervision and Control and knowing “what is in the box?”. We will explore commonsense suggestions for setting up client relationships and expectations using such resources as CBP’s Broker Guidance document, NCBFAA Revised POA book, and the NCBFAA revised Terms and Conditions.
